1. Agreement Overview
By purchasing or using MY-Indaba services, you agree to these Terms and Conditions.
2. Nature of Services
MY-Indaba provides creative storytelling services, including AI-enhanced visual representations, digital memorials, and legacy storytelling.
These services may include interpretive, enhanced, or AI-generated visual and audio representations based on submitted materials.
3. Co-Creation Process
Each project is a collaborative process between MY-Indaba and the client.
Clients agree to:
Provide accurate and complete information
Submit only materials they have permission to use
Respond to review requests in a timely manner
MY-Indaba agrees to:
Translate submitted materials into a meaningful and cohesive story
Deliver services aligned with the selected package
4. Creative Interpretation
Outputs may include AI-generated or enhanced representations and may not exactly replicate real-life events or appearances.
The goal is to reflect the spirit, emotion, and narrative of the story.
5. Client Content Responsibility
You are solely responsible for all content you provide.
By submitting materials, you confirm that:
You have the legal right to use all submitted content
You have permission to use the likeness, identity, voice, and story of any individual represented
Your content does not infringe on any third-party rights
MY-Indaba does not independently verify permissions.
6. Use of Likeness, Identity, and Digital Representation
By submitting content, you grant MY-Indaba a limited, non-exclusive right to use the name, image, likeness, voice, and identity of any individual solely for the purpose of creating and delivering the requested services.
You represent and warrant that:
You have obtained all necessary permissions and consents
You are authorized to act on behalf of the individual, their estate, or authorized representatives where applicable
You acknowledge that:
MY-Indaba may create AI-generated or digital representations (“digital replicas”) based on submitted materials
7. Sensitive Content Notice
Our Services may involve deeply personal or emotional content, including memories of loved ones.
You are encouraged to carefully consider the materials you choose to share.
8. Payment Terms
Mini Legacy Stories (Under $300)
Full payment required upfront
All Other Services
50 percent non-refundable deposit
50 percent due upon first proof
Final deliverables are released only after full payment.
9. Revisions
Mini: 1 revision
Full: 2 to 3 revisions
Revisions are intended for reasonable refinements, not full redesigns. Additional revisions may incur additional fees
10. Delivery Timelines
Mini: 3 to 5 business days
Full: 7 to 14 business days
Timelines may vary based on:
Client responsiveness
Quality of submitted materials
Project complexity
11. No Refund Policy
All payments are non-refundable once work has begun.
Due to the custom nature of the services:
All payments are non-refundable once work has begun
Deposits secure production time and project commitment
12. Use of Work for Marketing
MY-Indaba will request permission before using any project for marketing or portfolio purposes.
13. Intellectual Property
Clients retain ownership of submitted materials
MY-Indaba retains ownership of creative processes and production methods
14. Indemnification
You agree to indemnify and hold harmless MY-Indaba from any claims arising from:
Unauthorized use of identity or likeness
Lack of permissions
Intellectual property violations
15. Third-Party Services
We may use third-party providers to support our Services, including payment processing, storage, and communication tools.
MY-Indaba is not responsible for the privacy, security, or practices of these third-party providers.
16. Data Retention
We retain project-related content for a limited period:
Active projects → retained during production
Completed projects → typically retained for 30 to 90 days
After this period:
Files may be deleted from our systems
Clients are responsible for downloading and securely storing their final deliverables.
17. Data Security
We take reasonable administrative and technical measures to protect your information.
However, no system can guarantee complete security.
18. Minors and Consent
If submitted content includes minors, you confirm that:
You are a parent or legal guardian, or
You have obtained appropriate consent to share such content
We do not knowingly collect information directly from children.
19. Right to Refuse, Remove, or Discontinue Service
MY-Indaba reserves the right, at its sole discretion, to refuse, pause, remove, or discontinue any project if the content or request is deemed:
Inappropriate, offensive, or harmful
Misleading or misrepresentative
Lacking proper authorization or consent
Legally, ethically, or reputationally concerning
Not aligned with our values or service standards
MY-Indaba also reserves the right to remove or refuse content that may infringe on intellectual property rights.
If a project is declined before work begins, payment will be refunded.If a project is discontinued after work has begun, payments are non-refundable.
20. Limitation of Liability
Liability is limited to the amount paid.
21. Governing Law
These Terms and Conditions are governed by the laws of the State of Illinois.
